WEBSITE TERMS OF USE AND CLEANING SERVICE AGREEMENT

 

IMPORTANT: PLEASE READ THESE TERMS CAREFULLY BEFORE USING THIS WEBSITE OR BOOKING A SERVICE.

1. AGREEMENT AND ACCEPTANCE

These Website Terms of Use and Cleaning Service Agreement (the “Agreement”) govern access to and use of The Maid Society, LLC’s website, online booking pages, forms, text-message and email communications, and residential or commercial cleaning services. “The Maid Society,” “Company,” “we,” “us,” and “our” mean The Maid Society, LLC. “Client,” “Customer,” “you,” and “your” mean the person who accesses the website, requests a quote, books or pays for a service, authorizes another person to book a service, or receives services at a property.

By accessing or using the website, submitting a booking request, checking a box accepting these terms, authorizing payment, or allowing services to begin, you acknowledge that you have read, understood, and agreed to this Agreement. If you book on behalf of another person or property, you represent that you have authority to accept this Agreement on that person’s or property owner’s behalf.

If you do not agree to this Agreement, do not use the website or book or accept services.

2. WEBSITE USE

The website and its content are provided for lawful personal and business use related to learning about, requesting, booking, or managing The Maid Society’s services. You may not:

  • Use the website for unlawful, fraudulent, abusive, or deceptive purposes;
  • Attempt to gain unauthorized access to the website, booking system, accounts, or connected systems;
  • Copy, reproduce, republish, distribute, sell, or commercially exploit website content without written permission;
  • Introduce malware, automated scraping tools, or technology intended to interfere with the website; or
  • Misrepresent your identity, payment authority, property access authority, or service needs.

Website information may contain typographical or technical errors. We may correct errors, update content, or change website features at any time. A website display does not guarantee availability, acceptance of a booking, or a fixed price when the information supplied by the Client is incomplete or inaccurate.

3. INTELLECTUAL PROPERTY

The website, brand names, logos, text, graphics, photographs, service descriptions, forms, and other original content are owned by or licensed to The Maid Society and are protected by applicable intellectual-property laws. No ownership rights are transferred by your use of the website.

4. QUOTES, BOOKINGS, AND CLIENT DISCLOSURES

Quotes are based on the information supplied by the Client, including property size, bedrooms, bathrooms, condition, last professional cleaning, occupancy, pets, parking, access, requested services, and special circumstances. Unless expressly stated otherwise in writing, quotes are estimates based on the represented condition and scope.

The Client must provide complete and accurate information before service. Material omissions or inaccuracies may require a price adjustment, additional time, a change in service type, rescheduling, or cancellation. Examples include undisclosed heavy buildup, excessive clutter, post-construction dust, pet hair or waste, hoarding conditions, additional rooms, occupied move-out properties, inaccessible areas, or services not included in the original booking.

A booking is not confirmed until The Maid Society accepts it and the required payment method or authorization has been provided. We may decline or cancel a booking for scheduling, staffing, safety, service-area, payment, property-condition, or scope reasons.

5. PAYMENT AUTHORIZATION

The Maid Society accepts credit or debit card payments unless we expressly approve another payment method in writing. A valid card must remain on file for all booked services.

By providing payment information, booking a service, or authorizing another person to provide payment information, the Client represents that the Client is authorized to use the payment method and authorizes The Maid Society to charge the card on file for:

  • The confirmed service price;
  • Approved add-on services or additional labor;
  • Price adjustments permitted by this Agreement;
  • Applicable cancellation, lockout, parking, pet, last-minute, disposal, or other disclosed fees; and
  • Any unpaid balance lawfully due under this Agreement.

The Client must promptly update expired, declined, or invalid payment information. A failed, disputed, or reversed payment does not eliminate the obligation to pay for authorized services, fees, or costs already incurred.

6. PRICE AND SERVICE ADJUSTMENTS

The Maid Society may change advertised pricing for future services at any time. A change to advertised pricing will not retroactively change the confirmed base price of a service already booked.

The price or scope of a booked service may be adjusted when the Client provided inaccurate or incomplete information, the property materially differs from the booking description, additional services are requested, additional labor is authorized, or a disclosed contractual fee applies. When reasonably practicable, we will notify the Client before performing work that increases the price.

If the Client does not approve a necessary adjustment, The Maid Society may limit the work to the original scope, convert the booking to an hourly service if agreed, or cancel or reschedule the service. Work already performed and applicable fees remain payable.

7. RECURRING SERVICES

Recurring services continue at the selected frequency until canceled by the Client or The Maid Society. The price for recurring service is based on the frequency and interval between cleanings. Skipping or delaying a recurring appointment may cause the next appointment to be charged at the rate applicable to the longer interval.

The Client authorizes The Maid Society to charge the card on file for each recurring service and any properly disclosed fees or authorized adjustments. Recurring service may be canceled through the cancellation method made available by The Maid Society. Cancellation affects future appointments only and does not eliminate amounts already due.

The Maid Society may change recurring pricing for future appointments after providing notice as required by applicable law. Continued recurring service after the effective date of the disclosed change constitutes acceptance of the new price, except where additional affirmative consent is legally required.

8. ARRIVAL WINDOWS AND SCHEDULING

Appointment times are 1 hour arrival windows, not guaranteed exact arrival times, unless The Maid Society expressly confirms otherwise in writing. Traffic, prior appointments, staffing, property conditions, emergencies, and other circumstances may affect arrival.

We will make reasonable efforts to communicate material delays. An arrival within the stated window, or a reasonable delay communicated to the Client, does not constitute nonperformance.

The Maid Society determines staffing and may assign one or more cleaning professionals. We may change the assigned cleaner or team based on availability, illness, scheduling, performance, or business needs.

9. CLIENT CANCELLATIONS AND RESCHEDULING

The Client may cancel or reschedule an appointment without a cancellation fee by providing The Maid Society with at least twenty-four (24) hours’ notice before the scheduled appointment time.

If the Client cancels or requests to reschedule less than twenty-four (24) hours before the scheduled appointment time, a late-cancellation or late-rescheduling fee starting at seventy-nine dollars ($79) will apply. The applicable fee will be disclosed at booking, in the booking confirmation, or before the fee is charged.

If the Client cancels after the assigned cleaning professional has begun traveling to the property, has arrived at the property, or is otherwise present and prepared to begin the scheduled service, the cancellation will be treated as a same-day cancellation. The Client will be charged one hundred percent (100%) of the scheduled cleaning fee.

Notice provided only to a cleaning professional at the property does not constitute timely notice to The Maid Society’s office. All cancellations and rescheduling requests must be submitted through The Maid Society’s designated business phone number, text-message system, email address, booking portal, or another communication method approved by The Maid Society.

A cancellation or rescheduling request is considered received when it is delivered through an approved communication method. The Client is responsible for retaining the confirmation, email, text message, or other record showing when the request was submitted.

Cancellation and rescheduling fees are intended to compensate The Maid Society for reserved labor, cleaner commitments, administrative work, travel, lost booking opportunities, and other losses that are impracticable or difficult to calculate precisely when an appointment is canceled after time has been reserved.

A rescheduled appointment remains subject to this cancellation policy. Repeated cancellations or rescheduling requests may require prepayment, a new deposit, updated pricing, or additional booking conditions before another appointment is confirmed.

10. LOCKOUTS AND INABILITY TO ACCESS THE PROPERTY

The Client must provide complete and accurate entry instructions, keys, access codes, gate information, parking information, alarm instructions, and any required property, building, landlord, or security authorization before the scheduled appointment.

An appointment will be considered a lockout when the assigned cleaning professional cannot enter, begin, or continue the service because of a condition within the Client’s control, including:

  • Missing, incomplete, or incorrect access instructions;
  • A locked door, gate, building, elevator, or restricted entrance;
  • An unanswered call, text message, doorbell, intercom, or other reasonable attempt to contact the Client;
  • An active security alarm;
  • An uncontained, aggressive, or unsafe animal;
  • Unavailable running water or electricity;
  • The Client’s failure to obtain required property, building, landlord, management, or security authorization; or
  • Any other condition within the Client’s control that prevents the cleaning professional from safely entering or performing the service.

The Maid Society and its cleaning professionals are not required to wait indefinitely for the Client to provide access or correct the condition. Unless The Maid Society approves another arrangement, the cleaning professional may leave after making reasonable attempts to contact the Client and obtain access.

Because the appointment time, labor, and travel have already been committed, a lockout will be treated as a same-day cancellation. The Client will be charged one hundred percent (100%) of the scheduled cleaning fee.

If The Maid Society agrees to have the cleaning professional wait, waiting time will be charged at the applicable hourly rate disclosed in the booking terms or communicated to and approved by the Client. Waiting time begins at the scheduled appointment time or the cleaning professional’s arrival time, whichever occurs later.

Approval to wait does not guarantee that the entire original scope of service can be completed. If access is eventually provided, the service may be limited to the time remaining in the scheduled appointment or the cleaning professional’s remaining availability.

The Client remains responsible for the full scheduled cleaning fee unless The Maid Society agrees otherwise in writing.

Any return trip or rescheduled service resulting from a lockout will be treated as a separate appointment and may require a new booking, payment, deposit, or payment authorization.

11. UTILITIES, PARKING, AND WORKING CONDITIONS

The Client must provide safe access to functioning electricity, running water, and a sanitary work environment. The Client must disclose parking restrictions, permit requirements, stairs, elevator restrictions, construction activity, other contractors, or conditions likely to interfere with service.

When free and reasonably accessible parking is not available, a disclosed parking fee or actual parking cost may be charged. The Client is responsible for permits, towing risks created by the Client’s instructions, and legal access to the property.

The Maid Society may pause, limit, reschedule, or discontinue service if conditions are unsafe, utilities are unavailable, other people materially interfere with the work, the requested service is outside the agreed scope, or the property condition creates an undisclosed health or safety risk. The Client remains responsible for work performed and any applicable cancellation or service fee.

12. PEST INFESTATIONS & UNSAFE CONDITIONS

The Maid Society does not provide cleaning or pest-control services for active infestations of cockroaches, bed bugs, fleas, rodents, or other pests. Customers are required to disclose any known or suspected active pest infestation before the scheduled appointment.

If our cleaning professional encounters an active or suspected pest infestation at any time during service, The Maid Society reserves the right to immediately stop or discontinue service, either in the affected area or throughout the property, at our sole discretion. This determination may be made based on the health and safety of our cleaning professionals and the risk of pests contaminating or being transported through cleaning equipment, supplies, clothing, or personal belongings.

If an infestation is discovered after service has begun, the customer will be responsible for a minimum of 50% of the scheduled service price or the value of services already performed, whichever is greater. If the majority or entirety of the scheduled cleaning has been completed before service is discontinued, the customer remains responsible for the full service price.

The Maid Society is not responsible for portions of the home that cannot be cleaned or completed because of an active pest infestation or other unsafe condition.

Active pest infestations are excluded from our Happy Customer Guarantee while the infestation remains present. The Maid Society will not send a cleaning professional back into a property to perform a complimentary re-clean while an active or suspected infestation exists. At The Maid Society’s discretion, an alternative adjustment may be offered for a documented service concern; however, such an adjustment does not create an obligation to perform a re-clean.

If an infestation or other condition at the property causes or contributes to illness, allergic reaction, pest exposure, contamination of equipment or supplies, or another health or safety concern for our cleaning professional, The Maid Society may immediately terminate the service and decline to return to the property.

Future cleaning services may be scheduled after the infestation has been professionally treated and resolved. The Maid Society may request confirmation of professional pest treatment before accepting another appointment.

Failure to disclose a known active infestation may result in the customer being responsible for reasonable costs incurred by The Maid Society as a direct result of the undisclosed condition, including professional treatment of contaminated company-owned equipment or supplies, where permitted by law.

13. CLEANING SCOPE AND EXCLUDED TASKS

The cleaning scope is limited to the service and add-ons listed in the confirmed booking or later approved in writing. Cleaning professionals are not authorized to agree to material scope or price changes on behalf of The Maid Society.

Unless specifically booked and approved, services do not include:

  • Exterior cleaning, garden or yard work, power washing, or exterior windows;
  • Carpet shampooing, upholstery shampooing, restoration, remediation, or specialist treatment;
  • Biohazards, bodily fluids, feces, urine, vomit, blood, needles, hazardous chemicals, pest infestations, or mold remediation;
  • Moving heavy furniture, appliances, electronics, or objects exceeding twenty (20) pounds;
  • Work requiring climbing above a stable step stool or more than two ladder rungs;
  • Childcare, pet care, meal preparation, personal-assistant duties, or errands;
  • Cleaning inaccessible, unsafe, structurally unsound, or excessively obstructed areas; or
  • Services not listed in the booking or agreed to by the office.

The Maid Society is a general cleaning company, not a restoration, flooring, grout, tile, wall, mold, pest, construction, or specialty-remediation contractor.

14. SUPPLIES AND EQUIPMENT

The Maid Society generally arranges for cleaning professionals to arrive with ordinary cleaning supplies and equipment appropriate for the booked service. The Client must disclose special surface-care instructions and known manufacturer restrictions before service.

If the Client requests use of a specific product or equipment, the request must be approved before the appointment. Unless The Maid Society agrees otherwise in writing, the Client must supply the requested product or equipment. The Maid Society and its cleaning professionals are not required to purchase products, advance personal funds, or run errands for the Client.

The Client assumes the risk that a Client-selected or Client-supplied product or item may be ineffective, unsuitable, defective, expired, improperly labeled, or incompatible with a surface, except to the extent a loss is directly caused by conduct for which liability cannot lawfully be excluded.

15. PETS

The Client must disclose all pets and secure or contain them during service. The Maid Society does not clean litter boxes or animal urine, feces, vomit, or other biological waste.

The Client is responsible for preventing pets from escaping and for providing safe entry and exit. The Maid Society and its cleaning professionals will use reasonable care when entering and leaving, but are not responsible for an animal that escapes while unrestrained or because the Client failed to follow containment or access instructions, except to the extent caused by conduct for which liability cannot lawfully be excluded.

If undisclosed pets, excessive pet hair, pet waste, or pet-related conditions materially affect the work, an approved pet fee, additional labor charge, scope adjustment, or cancellation may apply.

16. CLUTTER, PERSONAL PROPERTY, AND VALUABLES

The Client must remove excessive clutter and provide reasonable access to surfaces to be cleaned. Cleaning professionals may clean around papers, valuables, delicate collections, unstable objects, and areas that cannot be safely accessed.

The Client must secure cash, jewelry, medication, firearms, confidential documents, heirlooms, and other valuable or sensitive items. The Client must disclose fragile, loose, improperly mounted, damaged, or irreplaceable items before service.

The Maid Society is not responsible for loss or damage caused by preexisting defects, ordinary wear, improper installation, unstable mounting, deterioration, manufacturer defects, or failure to disclose special care requirements, except to the extent prohibited by law.

17. MOVE-IN AND MOVE-OUT SERVICES

Move-in and move-out pricing assumes the property is vacant and totally empty unless otherwise stated in the confirmed booking. Cabinets, drawers, refrigerators, ovens, and similar areas must be emptied before interior cleaning.

Remaining furniture, trash, debris, personal property, food, or occupied areas may require additional labor, disposal fees, a service conversion, or rescheduling. The Maid Society does not haul away or dispose of property unless that service is separately approved and priced.

Move-out cleaning does not include carpet or upholstery shampooing, odor remediation, exterior work, repairs, painting, restoration, or services not listed in the booking.

18. POST-CONSTRUCTION, HOARDING, AND SPECIALTY CONDITIONS

Post-construction, renovation, excessive-debris, hoarding, and unusually heavy-condition services require advance disclosure and may require custom pricing, hourly billing, special equipment, additional staffing, or a specialized provider.

If such conditions were not disclosed, The Maid Society may revise the scope or price, convert the service to an approved hourly arrangement, decline unsafe or uninsurable tasks, or cancel or reschedule the appointment.

19. HOURLY SERVICES

Hourly services are billed according to the approved hourly rate and number of cleaning professionals. An hourly booking purchases labor time, not a guarantee that every requested task will be completed.

The Client is responsible for identifying priorities and purchasing enough time for the condition and scope. When the Client is present, concerns about pace or priorities should be communicated to The Maid Society while service is underway. Additional time requires approval and will be charged at the applicable rate.

For the Happy Customer Guarantee, any qualifying correction to an hourly service is limited to verified work that should reasonably have been completed during the purchased time. A re-clean does not create an entitlement to the same number of hours originally purchased.

20. 24-HOUR HAPPY CUSTOMER GUARANTEE

Because each cleaning service is customized and labor is performed at the Client’s property, completed services are nonrefundable. The Maid Society does not provide refunds, partial refunds, credits, or charge reversals based solely on dissatisfaction with a completed cleaning. Subject to this section, a complimentary re-clean is the Client’s sole contractual remedy for a qualifying service-quality concern.

To request a re-clean, the Client must notify The Maid Society in writing within twenty-four (24) hours after completion of the original cleaning service. The request must include:

  1. A specific written list of every area the Client believes was missed or requires additional attention; and
  2. Clear photographs or video showing each reported area.

General statements of dissatisfaction are insufficient. Any concern, room, surface, or area not specifically identified and documented within the original 24-hour reporting period will not be added to or honored as part of the complimentary re-clean.

The Maid Society will review the request and determine whether the reported concern falls within the confirmed scope. If approved, the complimentary re-clean will be limited to the verified areas requiring additional attention.

The guarantee does not cover:

  • Services, rooms, areas, or add-ons not included in the original booking;
  • New requests made after the original service;
  • Permanent stains, damage, discoloration, deterioration, wear, buildup, mineral deposits, mold, rust, or conditions that cannot reasonably be corrected through cleaning;
  • Areas that were inaccessible, obstructed, unsafe, excessively cluttered, or not disclosed;
  • Conditions caused or altered after service by occupants, guests, children, pets, contractors, movers, maintenance personnel, construction workers, or another cleaning provider;
  • Reaccumulation of dust, dirt, debris, hair, grease, moisture, or residue after completion; or
  • Results affected by Client-supplied products, equipment, or instructions.

A re-clean cannot be used to add a new service. Additional requested work is a separate service subject to current pricing, availability, and minimum-service requirements.

Approved re-cleans are generally offered within twenty-four (24) to forty-eight (48) hours after approval, subject to availability. The Client must cooperate with scheduling and provide timely, safe access. If the Client declines, cancels, delays, prevents, or fails to cooperate with the offered inspection or re-clean; fails to provide access; hires another provider; or alters the disputed areas before inspection, the guarantee will be considered satisfied and no refund, credit, or additional re-clean will be provided.

Failure to report and document all concerns within twenty-four (24) hours after completion constitutes acceptance of the service for purposes of this contractual guarantee and waiver of the complimentary re-clean remedy, but does not waive rights that cannot legally be waived.

Homes with an active or suspected pest infestation are not eligible for a re-clean until the infestation has been professionally treated and resolved.  See Pest Infestations & Unsafe Conditions.

21. DAMAGE, BREAKAGE, AND THEFT CLAIMS

The Client should inspect the property promptly after service. Any suspected damage, breakage, or missing property must be reported to The Maid Society in writing as soon as reasonably possible, preferably within twenty-four (24) hours, with photographs, video, receipts, ownership information, repair estimates, police reports when applicable, and other reasonably requested documentation.

Prompt notice is required so The Maid Society can preserve evidence, interview the cleaning professional, review photographs and time records, and inspect the property. Delay may limit our ability to investigate but does not waive rights that cannot legally be waived.

The Maid Society may elect, where appropriate and legally permitted, to inspect, repair, replace, reimburse the reasonable depreciated value, refer the matter to insurance, or deny an unsupported claim. No admission of liability is created by investigating a claim.

A theft allegation must be reported to The Maid Society and, when actual theft is alleged, to law enforcement. The Client agrees to reasonably cooperate with the investigation.

22. BEFORE-AND-AFTER PHOTOGRAPHS AND SERVICE RECORDS

The Maid Society and its cleaning professionals may take reasonable before-and-after photographs or videos of areas being serviced for quality control, service verification, contractor management, customer support, damage documentation, insurance, payment disputes, collections, or legal proceedings.

We will use reasonable efforts to avoid photographing people, personal documents, passwords, access codes, financial information, or other unnecessarily identifying information. Service documentation will not be used in public advertising or social-media marketing without separate consent from the Client.

23. CLEANING APPROVAL

A Client may approve the completed service verbally, by text, by email, through the booking platform, or through another written communication. Approval may be considered when evaluating a later guarantee request, but it does not waive rights that cannot legally be waived.

If the Client asks the team to wait for an in-person inspection, reasonable waiting-time charges may apply after any disclosed grace period. The Client must communicate concerns promptly and through The Maid Society’s office.

24. PAYMENT DISPUTES AND CHARGEBACKS

By authorizing payment and accepting services, the Client acknowledges that charges for services properly authorized, scheduled, and performed are valid and due.

Before initiating a chargeback or payment dispute concerning the quality, completeness, scope, cancellation, or performance of a cleaning service, the Client agrees to notify The Maid Society in writing and follow the applicable complaint, cancellation, or Happy Customer Guarantee procedure in this Agreement.

Any quality, completeness, or scope complaint must be submitted through the 24-Hour Happy Customer Guarantee. The Client must report all concerns within twenty-four (24) hours after completion, identify and document each disputed area, and allow The Maid Society a reasonable opportunity to inspect and perform an approved re-clean.

The Client agrees not to initiate or maintain a chargeback based on alleged quality, incompleteness, or dissatisfaction when the Client:

  1. Failed to report the concern within the 24-hour period;
  2. Failed to identify and document the disputed areas as required;
  3. Declined, canceled, delayed, prevented, or failed to cooperate with an offered inspection or re-clean;
  4. Failed to provide timely or safe access for the re-clean;
  5. Hired another person or company to alter, clean, repair, or service the disputed areas before The Maid Society could inspect or correct them;
  6. Demanded a refund or reversal instead of permitting the agreed contractual remedy; or
  7. Based the dispute on services, rooms, areas, or add-ons not included in the confirmed booking.

When the Client fails to comply with the Happy Customer Guarantee or denies The Maid Society the opportunity to correct a qualifying concern, the Client acknowledges that The Maid Society has not refused to remedy the complaint and that the Client is not contractually entitled to a refund or payment reversal based solely on dissatisfaction.

The Client shall not knowingly initiate or maintain a false, fraudulent, misleading, or materially inaccurate dispute, including a claim that:

  1. The Client did not authorize a transaction that the Client or an authorized representative booked or approved;
  2. Services were not provided when service records establish that cleaning professionals entered the property and performed work;
  3. The amount was unauthorized when it was disclosed, approved, or properly adjusted under this Agreement;
  4. The Client timely canceled when cancellation was not completed under the stated procedure; or
  5. The Client was denied a remedy after failing to submit a timely claim or declining, preventing, or failing to cooperate with the offered remedy.

A chargeback, provisional credit, payment dispute, or reversal does not eliminate the Client’s contractual obligation to pay for authorized services. If funds are withdrawn and the dispute concerns a valid charge, untimely quality complaint, or complaint for which the Client denied an opportunity to inspect or re-clean, the unpaid balance becomes immediately due, together with lawful chargeback fees, collection costs, interest, and enforcement expenses provided by this Agreement.

Nothing in this section prohibits the Client from exercising a dispute right that cannot legally be waived, including disputing a genuinely unauthorized transaction, duplicate charge, incorrect amount, or legitimate billing error.

25. COLLECTION COSTS, LEGAL FEES, AND INTEREST

If the Client fails to pay an amount properly due, wrongfully reverses an authorized payment, or otherwise breaches the payment obligations in this Agreement, The Maid Society may pursue lawful collection remedies, including collection activity or a civil or small-claims action.

The prevailing party in an action or proceeding arising from enforcement of this Agreement is entitled to recover reasonable attorneys’ fees, court costs, filing fees, service-of-process fees, and other recoverable litigation costs, to the extent permitted by applicable law.

The Client is also responsible for reasonable payment-processor chargeback fees and lawful collection expenses caused by a wrongful payment reversal, to the extent recoverable under applicable law.

Any unpaid balance will accrue simple interest from the date due at the lesser of ten percent (10%) per year or the maximum rate permitted by applicable law. Interest continues until paid or reduced to judgment. A judgment will bear interest at the rate provided by law.

The Client remains responsible for the original balance notwithstanding a temporary credit, provisional refund, chargeback, reversal, or withdrawal issued by a financial institution.

26. DIRECT HIRING OR CIRCUMVENTION

The Maid Society invests substantial time and expense recruiting, screening, onboarding, scheduling, supporting, and introducing cleaning professionals to Clients. During the service relationship and for twelve (12) months after the cleaning professional last performed services for the Client through The Maid Society, the Client agrees not to knowingly bypass The Maid Society to directly hire, engage, pay, or solicit that cleaning professional for substantially similar cleaning services without The Maid Society’s written consent.

If the Client wishes to directly engage a cleaning professional introduced through The Maid Society, the Client must contact The Maid Society to discuss a lawful placement or transition arrangement. This section is intended to protect The Maid Society’s customer relationships and investment and will be enforced only to the extent permitted by California law. It does not restrict a cleaning professional’s lawful occupation or rights.

27. CALLS, TEXTS, AND ELECTRONIC COMMUNICATIONS

The Client consents to receiving transactional calls, emails, and text messages related to quotes, bookings, access, service updates, payments, customer support, recurring appointments, and account administration at the contact information provided. Message and data rates may apply.

Marketing messages will be sent only as permitted by law, and the Client may use the stated opt-out method.

Calls may be recorded for quality assurance, training, documentation, and dispute resolution. When a call will be recorded, callers will be notified at or before the beginning of the recording. By remaining on the call after receiving notice, the caller consents to recording to the extent permitted by law.

28. THIRD-PARTY LINKS AND SERVICES

The website may link to third-party payment processors, scheduling platforms, maps, review sites, social networks, or other services. The Maid Society does not control and is not responsible for third-party content, availability, privacy practices, or security. Use of third-party services may be subject to separate terms.

29. DISCLAIMERS

The website is provided on an “as available” basis. To the fullest extent permitted by law, The Maid Society does not guarantee that the website will be uninterrupted, error-free, or compatible with every device.

Cleaning results vary based on age, condition, material, prior care, buildup, staining, damage, access, available time, and the scope purchased. The Maid Society does not guarantee removal of permanent stains, odors, discoloration, mineral deposits, mold, rust, deterioration, or preexisting damage.

Nothing in this Agreement excludes warranties, duties, or remedies that cannot lawfully be excluded.

30. LIMITATION OF LIABILITY

To the fullest extent permitted by law, The Maid Society will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost use, business interruption, or emotional distress, arising from the website or services.

To the fullest extent permitted by law, The Maid Society’s aggregate contractual liability arising from a particular cleaning service will not exceed the amount the Client paid for that service, except for liability that cannot lawfully be limited, including liability arising from fraud, willful misconduct, or other nonwaivable obligations.

This section does not limit remedies or liability that California law does not permit the parties to waive or restrict.

31. INDEPENDENT SERVICE PROVIDERS

The Maid Society may fulfill services through employees, independent cleaning professionals, or subcontracted service providers, as permitted by law and business needs. The Maid Society controls customer booking, pricing, payment, service administration, and customer support. Nothing in this Agreement creates a partnership, joint venture, or agency relationship between the Client and The Maid Society’s personnel.

32. SUSPENSION OR TERMINATION OF SERVICE

The Maid Society may refuse, suspend, or terminate website access, bookings, recurring service, or future service for nonpayment, unsafe conditions, harassment, discrimination, threats, fraud, repeated chargebacks, repeated lockouts, policy violations, unreasonable interference, out-of-scope demands, or other legitimate business reasons.

Termination of future service does not eliminate payment obligations, fees, claims, or provisions intended to survive termination.

33. GOVERNING LAW AND VENUE

This Agreement is governed by the laws of the State of California, without regard to conflict-of-law principles. To the extent permitted by law, any court action arising from this Agreement must be brought in a court of competent jurisdiction located in Los Angeles County, California. Nothing in this section prevents a party from bringing an eligible claim in small-claims court or exercising a venue right that cannot legally be waived.

34. CHANGES TO THIS AGREEMENT

The Maid Society may update these terms for future website use and future services. The current version and effective date will be posted on the website. Changes will not retroactively alter rights and obligations arising from a completed service unless the parties agree or applicable law permits.

When legally required, The Maid Society will provide notice or obtain consent before applying material changes to recurring services or ongoing payment arrangements.

35. SEVERABILITY, WAIVER, AND ENTIRE AGREEMENT

If a provision is held invalid or unenforceable, it will be modified or severed to the minimum extent necessary, and the remaining provisions will remain effective.

A failure to enforce a provision is not a waiver of the right to enforce it later. A waiver must be in writing and applies only to the specific matter stated.

This Agreement, the confirmed booking, applicable service checklist, authorized quote, invoice, and any written addendum constitute the agreement between the Client and The Maid Society concerning the service. If a service-specific written term conflicts with this general Agreement, the more specific term controls for that service.
